GENERAL BUSINESS TERMS AND CONDITIONS of Květinový svět Ltd. valid from November 1 st, 2009

1. Basic terms

1.1 These general business terms and conditions are an indivisible part of all purchase contracts between Květinovy Svět Ltd. and its customers.
1.2 The vendor is Květinový Svět Ltd. ICO 283858291, based at Bělehradská 124, 12000 Prague 2, registered in the commercial register led by the municipal court in Prague, section C, inset 13785. The vendor is an operator of an internet shop with flowers and supplementary goods (E-shop).
1.3 The vendee is an individual or a corporate body, who, based on an order buys goods or requests its delivery to a consignee at a scheduled place.
1.4 A consignee is an individual or a corporate body to whom the vendor sends goods to at a scheduled place according to an order from the vendee.
1.5 The transporter is a professional transporting company.
1.6 The list of goods as well as the price list is placed on the web sites of the vendor www.bellesfleurs.cz or www.kvetinovysvet.cz


2. Goods and services order

The goods and services may be ordered by these means:

2.1 An in-store order on the premises of Belles Fleurs:

Bělehradská 124, Praha 2
Open daily Mon – Sun 7:30 am – 8:30 pm.

2.2 On-line order through the website www.bellesfeurs.cz or www.kvetinovysvet.cz. After sending and paying for the order, the vendee receives an email confirmation about the successful order. The vendee is expected to check the order confirmation and in case of incorrect information about subject of the order or the place of delivery, is to contact Belles Fleurs immediately by phone at: 530 506 870 and correct this information. Later complaints caused by inconsistent information in the order will not be taken into account.

Should you be interested in continual customer database registration, please click on the top right „registration“ button and fill in the registration form. In the case of registration you may receive information about interesting offers. When doing your next purchase you will simply log in through the „log in“ button. If you are not a registered customer, please fill in all required information about yourself and the consignee. The Registration is not required for making an order.

2.3 A telephone order at 530 506 870. Orders will be taken from Monday to Friday 8:00 am till 8:00 pm, weekends from 10:00 am until 6:00 pm. In case of this kind of order it is necessary to pay for the order at one of the vendor´s premises one day prior to delivery.

2.4 An e-mail order at belehradska@bellesfleurs.cz, the subject of which email should be: FLOWER ORDER. In the main text please state the following: 1. goods specification, 2. the method of collection (in-store pick up or delivery to the consignee), 3. information about the vendee (name or company name, address, phone number), 4. information about the consignee (name or company name, full address including floor, door number and phone number), 5. required delivery time. In case of this kind of order, it is necessary to pay for the order at one of the vendor´s premises one day prior to delivery.

Goods specification example:
Who the bouquet is for (woman/wife/daughter/man), what the occasion is (birthday/graduation ceremony/bridal etc), type and number of flowers (roses, 9pc/various flowers – not roses 9pc etc), colour, size and shape of the bouquet (colourful with more pink in it/large/round shape/etc.), price (max 1000,- Kc), text on the card.

When choosing the bouquet from an E-shop offer you may simply write down the bouquet name, size, number of pieces and card text. The bouquets in the pictures are medium size.

2.5 Last same-days orders need to be completed (payment included) by 3.30 pm (tariff NORMAL) or until 5 pm (tariff EXPRESS).

When delivery is for the following day or later, the last order may be made until 6.30 pm on work days (both tariffs) and until 4.30 pm on public holidays and weekends.


3. Goods delivery

The goods may be delivered by the following means:

3.1 In-store pick up at the premises of Belles Fleurs.
3.2 Delivery to the consignee – PRAGUE ONLY
3.2.1 When this kind of delivery is chosen the vendor, sends the goods to the consignee and location indicated by the vendee. The goods transportation is done by a transporter.
3.2.2 The transporter delivers the goods to the set location and gives them to the consignee during the period of conveyance. The vendor provides the trasporter with information about the place, consignee and the period of conveyance according to the vendee´s order.
3.2.3 The consignee is expected to be present at the set location during the period of conveyance. If otherwise, the trasporter is allowed to give the goods over to another person providing him with a written confirmation. This does not apply to situations when the vendee literaly requires strictly private delivery. The transporter is not obliged to check the consignee´s ID.
3.2.4 In case the consignee refuses to accept the goods, or it is impossible to deliver the goods especially due to an incorrect or non-existant address, the absence of consignee or any other person who could accept the goods, the transporter is due to inform the vendee or the vendor about this fact immediatelly. He will then be instructed with regard to next steps. The price for performing any additonal instructions is to be paid by the vendee. If the transporter does not receive any further instructions in 10 minutes, or if there is no possibility to fulfill these instructions the transporter returns the goods to the vendor. The duty of the transporter to deliver the goods is then discharged.
3.2.5 In the case the of consignee´s absence at a set location, it is also possible to re-deliver the goods. If the repeated delivery was not succesfully accomplished because of incorrect or incomplete consignee contact information given by the vendee, the re-delivery fee (which is double the regular delivery fee) is owed to the vendor. Repeated delivery will be done in the shortest time possible after the fee payment. The fee may be paid at one of our premises as well as on-line. If the fee is not paid, the consignment is considered as satisfied even if the takeover of goods did not actually happen.


4. Period of conveyance

4.1 The goods delivery is done by a transporter in the period of conveyance which is within 3.5 hours (tariff Normal) or within 2 hours (tariff Express) from the order payment. If the goods are ordered in advance, the period of conveyance is equal to the period of the appropriate tariff and will therefore correspond to time specified before the goods delivery.

4.2 The consignee must be present at the place of delivery during the period of conveyance, which is 3.5 hours (tariff Normal) or 2 hours (tariff Express) before the delivery time required in the order.

4.3 Evening delivery in night is only provided during work days until 10:00 pm.

4.4 It is impossible to deliver the goods at an exact time, therefore the above delivery time schedule provided.

5. Order payment

5.1 When picking up the goods in the store, payment may be made by credit card or cash, and in case of an on-line order you may use your on-line card.
5.2 When the goods are delivered to the consignee the order may be paid for with cash or credit card in the store, and in case of on-line order with your on-line card or cash on delivery.
5.3 We accept the following credit cards (in the store or on-line): VISA, VISA ELECTRON, MASTERCARD, MAESTRO.
5.4 Payment by bank transfer is only accepted when an order is in the value of 10 000,- Kc or greater and made according to a previous personal or phone agreement (tel: 530 506 870). The order will then be processed after receiving the payment to account no: 220877314/0300.
5.5 The order will only be processed after receiving the payment, cash on delivery orders excluded or cash payment. The overall order price consists of the goods price (the price of a bouquet does not include the vase; the vase cannot be purchased and is only a decoration), the transport price and eventually the cash on delivery price.
5.6 The price of goods is based on a price list provided by the vendor valid to the date of order. The price of the bouquet is based on the flower prices on the Holland stock exchange. The prices are also connected to the season, so the actual price of a flower may change throughout the year.
5.7 The price of transport is based on the price list attached to these terms and conditions.
5.8 An invoice for delivered goods can only be provided after the order payment.

6. Goods receipt and claims

6.1 The consignee takes over the goods when signing the delivery papers and also hereby confirms that the goods were received in good condition. In case of damaged goods (e.g. broken flowers), the consignee is expected to inform the vendor of this fact at tel. 530 506 870. Later complaints will not be taken into account.

6.2 The vendor is not responsible for incorrect contact information of the consignee nor for the consignee´s absence from the place of delivery during the delivery time.

7. Order cancellation

7.1 The vendee may cancel the order only via an email form sent to belehradska@bellesfleurs.cz. Orders may only be cancelled in the 24 hour period before the delivery time required in the order.
7.2 A cancellation fee will charged and is 50% of the overall original order price

8. Flower exchange

8.1 With regard to the fact that some flowers are seasonal, and due to direct dependence on flower import the vendor reserves the right to replace the type or colour of the flowers displayed in photographs on our websites up to 25%.
8.2 In case of the necessity to replace in excess of 25% the vendor will immediately contact the vendee and will agree on further steps.

9. Final arrangements and name and description protection

9.1 The vendor is obliged to keep secret all information about the goods and place of delivery from all unauthorized people. The vendor is obliged to respect and protect the name and description of the vendee according to act no.:101/2002 Sb.regarding the Name and Description Protection, the main text. The names and description provided will be processed and kept in the protected info system of the vendor. The vendor may legally control the correctness of provided information regarding the truth and possible misuse of this information that may be in violation of Czech legal order, or if the information was not provided by someone who should not have access to such information. The vendor will only use the provided information for successful order processing, goods delivery or possible claims. The vendee hereby accepts providing this information in order to deliver the consignment.
9.2 All legislative relations between the vendor and the vendee are based on Czech law. In matters that are not stated in other contracts or these terms and conditions, the appropriate part of Commercial Code may be used.
9.3 The business terms and conditions are superior to other possible statements by persons posing in the name of the vendor, unless this other statement is written and signed by a person with legal right to do so.
9.4 The vendor is entitled to change these business terms and conditions anytime. In case of change of the original terms and conditions, these become valid the moment they are displayed on the vendor´s web site. The changes shall not have any sort of influence on previously ordered goods.
9.5 By making an order the vendee accepts these business terms and conditions.
